The City of Lithonia, Georgia, is seeking qualified attorneys interested in serving as the Municipal Prosecutor for the Lithonia Municipal court.
PURPOSE AND SCOPE OF SERVICES
DESCRIPTION: The Municipal Prosecutor performs advanced professional legal work involving the prosecution of suspects in misdemeanor criminal cases, city ordinances, and participates in administrative and research functions in civil areas when requested. The Municipal Prosecutor will prosecute cases within the jurisdiction of the Lithonia Municipal Court.
Education and Experience: Minimum qualifications include a Juris Doctorate degree from an accredited law school, license to practice law in the state of Georgia, membership in the Georgia State Bar Association, and three (3) years of experience as a practicing attorney.
Knowledge, Skills, and Abilities: Knowledge of proper courtroom procedure and the rules of evidence; working knowledge of criminal law; working knowledge of local ordinances, laws and procedures; skill in basic supervisory principles and practices; ability to grasp complex factual data, draw appropriate conclusions, and an ability to communicate complex legal ideas to a variety of audiences in a clear, comprehensive and professional manner; the ability to read, interpret, apply and explain codes, rules, regulations, policies and procedures; ability to establish and maintain effective work relationships with City administration, City Council, Municipal Judge, Police Department, court staff, and the general public.
Manages assigned caseload; attends scheduled court appearances; creates new case files; inputs and records case-related data and notes; logs case activities; closes files; receives and reviews calendars; and coordinates with court administration, clients, witnesses, experts and others.
Maintains a comprehensive, current knowledge in appropriate legal fields; attends conferences, seminars, meetings and training events relevant to area of expertise; keeps abreast of legal changes; and participates in professional organizations.
Term: The Municipal Prosecutor appointment will last for the term of one year, but is subject to renewal at the will of the City Council of Lithonia.
Compensations/Hours of Work: The City of Lithonia Municipal Court is held at the Lithonia City Complex, 6920 Main Street, Lithonia Georgia 30058, on the 1st and 2nd Fridays of the month at 9:00 am and on the 4th Monday of the month at 6:00 pm. The City will compensate the selected Solicitor $275 per session for court services.
Reporting: The Municipal Prosecutor shall file monthly reports with the City detailing dates and times for services provided in accordance with an agreement. The report is due on or before the tenth (10th) day of the following month for services of the prior month.
Associate Counsel: Any counsel substituting for the Municipal Prosecutor shall have the authority to perform the services described in this announcement. The Municipal Prosecutor may suggest a replacement in his/her absence but the decision remains with the City; however, the associate counsel may only perform services not to exceed 25% of the court sessions for the Municipal Prosecutor. The Municipal Prosecutor and associate counsel hired pursuant to this announcement shall be admitted to practice pursuant to the rules of the Supreme Court of the State of Georgia.
Attorney Conflict: In the event the Municipal Prosecutor must withdraw from a case because of a conflict of interest, the Municipal Prosecutor shall be responsible for providing a conflict attorney at the Municipal Prosecutor’s expense.
Accessibility: The Municipal Prosecutor shall provide a contact telephone number so that the Municipal Prosecutor can be accessible to the Court staff, Police department and defendants. The Municipal Prosecutor will be required to respond to the Court Staff and the Police Department by the close of the next business day and respond to defendants in a timely manner.
Professional Liability Coverage: During the term of the Contract, the Municipal Prosecutor shall have professional liability coverage.
Indemnifications: The Municipal Prosecutor shall indemnify, defend and hold the City, its elected officials and employees, agents and volunteers harmless from any and all claims, losses or liability, including all costs and attorney fees, arising out of the Municipal Prosecutors performance of obligations pursuant to the appointment, including claims arising by reason of accident injury or death caused to the persons or property of any kind occurring by fault or negligence of the Municipal Prosecutor, his or her associates, agents and employees. To the extent that any of the damages referenced by this paragraph are caused by or resulting from concurrent negligence of the City, its agents or employees, this obligation to indemnify, defend and hold harmless is valid and enforceable only to the extent of the negligence of the Municipal Prosecutor, its officers, associates, agents and employees.
Assignment of Subcontractors: No assignment or transfer of the appointment shall be made by the Municipal Prosecutor without prior written consent of the City.

- Cover letter and statement of qualifications
- Georgia State Bar Numbers for all attorneys
- Three professional references with addresses and phone numbers
- Release allowing the City of Lithonia access to all GSBA disciplinary investigations and or actions.
- Copy of current professional liability insurance, name of carrier and policy number, policy exclusions, if any, and current coverage amounts.
